Who Owns America?


Today after doing programs and works on my class, I did a daily read on my newspaper as usually, I always find myself going to a local reporter blog all the time call “Journey to Justice” by Jerry Mitchell. Jerry is an investigative reporter for the Clarion Ledger and he has been doing this for 4 months now. He got a piece on his blog talking about the aftermath of the healthcare reform overhaul signed by President Obama and why there is so much rage over this. He hit this paragraph along with Leonard Zeskind , president of the Institute for Research and & Education on Human Rights, on the head with this one.

Much of the rage spilling over from the health care debate has little to do with public policy.It’s all about who owns America. To quote them, they want their country back.

Sometimes change is something that we have to just accept. The Tea Partiers are people who cannot accept change. Check this out.

You have been training on the job for 4 years. One day, A new boss comes in and start changing things around. Now you can tell him all you want how this job is done, but at the end of the day, he want things done either his way or the highway. You pout, get mad, snicker, tell rumors, and even plot on how to get your boss fired until one day either you are fired, quit, or have changed. That is how America is now. Most people have learned to adjust while others are still griping at something that is not going to change until either they learn to live with it or now. I can tell you that growing up in a town where in the 60s, 70s, and 80s a rest- haven was for tourists to the days of now where historic sites are hanging on a string (no pun). You have people that cannot accept that change did come and times have outgrown either you or the person next to you. You are sacred because the things that you are use to is dimishing and your privileges are not what they use to be. So the question is….

“Who owns America?”

The answer is “We all do. If you were born here, or even became a citizen here. You own a piece of what is the greatest country in the world.”

Tea partiers need to know that violence to one does not help it and lies makes it worse. Most of the talk show pundits do not come to projects, surburbs that people have been trying to take back, and small towns that are run down either because of people hatred of their skin or living. America is not Ozzie and Harriet (for those who don’t know what I am talking about, google that one). It is the places where dreams can come true if you make them, but you have to earn it. Even Barry “Mr. Conservative” Goldwater said the following quote in 1964.

"Extremism in defense of liberty is no vice.I would remind you that extremism in the defense of liberty is no vice. And let me remind you also that moderation in the pursuit of justice is no virtue.

The beauty of the very system we Republicans are pledged to restore and revitalize, the beauty of this Federal system of ours is in its reconciliation of diversity with unity. We must not see malice in honest differences of opinion, and no matter how great, so long as they are not inconsistent with the pledges we have given to each other in and through our Constitution."

So when some Tea Partier ask you “Do you want to take America back?”

Tell them, “America has never left me, I just adjusted to what America is offering me.”

The C.Y.N.I.C.A.L Side of: UCONN Huskies Women's Basketball Team












I can really say that being a sports fan, either you like the underdog and you love your favorite. I can tell you things like this.

In the NFL, you love the Cowboys or you really, really hate them.

In the NBA, you love the Lakers or you really, really hate them.

In Major League Baseball, you love the Yankees or the Red Sox or you really, really hate them (sorry, both are annoying at times).

In college football, you love THE Ohio State University Buckeyes or you really, really hate them.

In men’s college basketball, you love the Duke Blue Devils or you really, really hate them (...and you don’t have to be an UNC fan for that one).

And now it has spewed over into women college basketball.

In women’s college basketball, you love the UCONN Huskies or you really, really hate them.


I cannot feel sympathy for the rest of women’s college basketball when I say that UCONN is either “that good” or women’s college basketball recruitment has gotten “that bad.” Geno Auriemma is really that legendary of a coach. Their dominance in the women’s rank has gone down as even legendary as those Tennessee Lady Vols day and even Louisiana Tech dominance in the early 80s with the short sleeve jerseys. They play the game with great fundamentals and every time they usually have a backup player waiting to place their status of women’s basketball legendaries when their players graduate. You remember those old UCLA teams in the 60s. John Wooden replaced Lew Alcindor with Bill Walton, Gail Goodrich with Lynn Shackleford and Sidney Wicks with Keith Wilkes. Other colleges just ended up stepping the recruitment up after that.

So for all the women’s college basketball coaches that want to end UCONN, here is a note. Start recruiting better.

Next week is opening day of my favorite season for maybe about 2 months and every other day when something literally happen.

…Jason Heyward.

Jason Heyward had the baseball world talking when he blasted a homerun off Max Scherzer (Detroit Tiger’s pitcher), but it wasn’t because of the pitcher. It was because of how high he blasted it off him. Jim Leyland, legendary coach from the Pittsburgh Pirates, Florida Marlins, and now the Dertroit Tigers said this about Jason.

“I’ve never been one to get excited about the distance. Anything hit over the fence counts a point,” said Tiger manager Jim Leyland. “But obviously a young man with his size, with the strength he has, he looks like a really good looking young player. I was very impressed with his patience at the plate more than anything. He didn’t chase any bad balls. (Albert) Pujols was the other guy who was like that.”
Leyland is comparing him to The Machine and Boss Cox is comparing him to Hamering Hank is something big time. Let just hope he something spectacular for years to come. Don't think so, look at this.

It's about free speech, not the money

In 2007, Paris Hilton sued cards company Hallmark over a greeting card that sort of featured her. The card was called “Paris’s First Day as a Waitress,” and showed Hilton saying to the customer, “That’s hot” — a phrase she used frequently in her reality television show, “The Simple Life.” The inside of the card reads: “Have a smokin’ hot birthday.” It’s basically a spoof of everything we’d expect to see spoofed about her.
However, Hilton wasn’t too happy that Hallmark did this without her permission, claiming “misappropriation of publicity” under Californian law. Two courts refused to dismiss the lawsuit, but whatever the legal process is, I honestly hope that the ending isn’t a “misappropriation of publicity” conclusion, because that would be setting a very wrongful precedent in a case of First Amendment rights.
Hallmark creating a card truthfully (although a few may disagree) depicting what Hilton factually is like. Is someone honestly going to tell me that what Hilton says in the card isn’t characteristic of her, or of what she’s said in the past? Hallmark has every right to create a spoof of her when at the very least, they’ve created a cartoony-version of her, put her in a made-up situation, and added some phrases for the sole purpose of creating an interesting birthday card. In terms of First Amendment rights, it would be as if a newspaper wasn’t allowed to create caricatures or political cartoons of notable people and would get sued for it. How does that make any sense? Part of the First Amendment is being able to incorporate other people in order to deliver a message. It’s ridiculous to say that we can’t freely do so.
Furthermore, in the article it is noted that the “classical” misappropriation case involves the celebrity who is “embarrassed or humiliated by unwanted displays of his or her image.” This is clearly not the case here. This is not a hypothetical case of Hilton drinking out of a beer bong and yelling “this stuff rocks” while totally drunk. That would be false endorsement, and I can understand why someone would have to ask her permission first, but that is not the case here. With the birthday card, she is not endorsing anything, and certainly nothing “embarrassing or humiliating.” This whole lawsuit revolves around Hiliton’s desire to get some cash out of Hallmark, and money shouldn’t get in the way of our First Amendment rights.

I remember December 9, 2002, I wrote a post about Kelis channeling back 1997-2002. That was pretty much the first time I really got some pretty shaky reponses (I am a Kelis fan, but wow, they made me look like I wasn’t. Sorry, just didn’t like her third and fourth album. Seriously, they are not too hot.) Well after all the courts, paychecks, and looking like this……..

…….articles are out that she is going to do a fifth album. This time she is collaborating with Black Eye Peas’ Will.I.Am which is pretty cool seeming that both are creative. To tell you the truth, I am glad she left Jive records. They really made her sound crappy after the second album. I been telling people that Kelis is “poetry in motion,” and Will.I.Am is going to polish the jewel (please, no pun).

But not everybody is happy with her working on a new album.

And by the way if you guys think that Kelis is going to be receiving alimony from Nas for 18 years...you need to know the law of CA! Nas was not married to her for 10 years or more...she will only get alimony for a limited time most likely a year. That is why she was back to work so soon after giving birth! If Kelis could be a stay at home mother she would! Kelis has no choice but to work because she will be paying 50% percent of that child support and her alimony will be voided if it is not already! Why would Nas have to pay her alimony for 18 years he was only married to her for 3 years? Now this is under a 18-hour span. Though she has many fans (myself included), what she pull off with Nas was illmatic (definitely, no pun intended) and left so many people to question her greed. The Dilemmatic Decision for Artur Davis


After all the HCR yielding, time limit, and time expiration, the HCR got passed. Time will only tell in what direction will it takes us. During the time that people were angry, saying racial slurs, and all sorts of things in the wide, wide, world of America, I had to think about the CBC. Everybody was saying that all the CBC was going to side yeah with the health care reform…..

Hold up. There was one member of the CBC that did not vote yes on that bill.

On Friday, Black Caucus members took turns lauding its provisions that specifically benefit minority communities, such as adding health centers in low-income neighborhoods, expanding the Office of Minority Health and the U.S. Department of Health and Human Services, expanding the National Center on Minority Health and Health Disparities at the National Institutes of Health, and making more lower-income families eligible for Medicaid. "It is good for America. It is good for black America," said Rep. Danny Davis, D-Ill.

Artur Davis, in an interview off the House floor Friday, didn't dispute the bill contains things he supports that would be good for his district: barring insurance companies from dropping coverage for pre-existing conditions; expanding Medicaid; providing subsidies to low-income people to afford insurance; and helping small businesses provide coverage for their employees.

"But all of these things can be done at half the cost without a 3,000-page, near trillion-dollar overhaul of the system," Davis said. "That's my point of disagreement. Where I stand is in support of a more targeted approach that is less expensive

Now you might be thinking “Why did this guy say no to the bill knowing that African-Americans will stand to gain ground on it.” Or you may just call him the House Negro of the Day like in one of my favorite blogs to read "Field Negro".

….but I believe he just step into something that can make him historic.

Artur Davis For Governor of Alabama

Artur may was thinking about his district, which is majority African-American; but being that Alabama is conservative altogether, he step in for the whole state of Alabama. If nobody remembers, he could be the next Governor of Alabama because 1) he is the front-runner and 2) The candidates the Republican have either have dents in their records or no record of representing the state at all. To African-Americans in the United States this may be just a little “Why did you do that,” but to all minorities and democratic leaders in Alabama, this may be the smartest move ever made. They knew that they were going to get 216 long before that. So Artur Davis just set himself up for the major prize, Governor of Alabama.

Come to think about it, he is a front-runner for Governor of Alabama. Remember Alabama! That is the state that Rosa Parks, refuse to give up her seat, Martin Luther King made a name for himself in this state, George Wallace shouted out “Separate but equal,” and Bear Bryant did not get a black player on his prestigious Alabama Crimson Tide until Sam “Bam” Cunningham of USC roasted them in 1970. So for Arthur Davis saying no, I ain’t mad at you. Keep your eyes on the prize, fella.

A Question of Distaste

A news brief in the March 22 issue of Time Magazine chronicles a clash of the freedom of speech and poor taste.

In 2006, Albert Snyder’s son, a Marine, was killed in Iraq. The ensuing funeral failed to provide the father the comfort or closure he needed. That’s because Snyder’s funeral was chosen as a protest point for the Westboro Baptist Church. The organization, run by Fred Phelps out of Topeka, Kansas, is aggressively anti-gay. According to Time, its members believe that American troops die in combat because the United States accepts and allows homosexuality. Members of the church raise awareness of their beliefs by attending military funerals and holding signs that say things like “Thank God for dead soldiers.”

When Albert Snyder sued the church for its members’ funeral behavior, he won almost $11 million in emotional distress damages. But that amount was later reduced, and, later, the Fourth Circuit Court of Appeals nullified the ruling. In September 2009, the Court termed the church’s behavior “repugnant,” but, according to Time, could not deny its legality.

Now the Supreme Court has agreed to consider the Snyder v. Phelps case. The Court’s decision this fall will determine whether offensive protests like the Westboro Church’s are actually protected by the First Amendment.

It may be tempting to hope the Court decides in favor of Snyder. However, such a decision would have dramatic effects on the breadth of the First Amendment’s freedom of speech clause. It is important that the First Amendment be as far from exclusionary as possible; to ensure maximum, necessary rights, it must encompass all speech, no matter how distasteful.

What should actually be hoped is that individuals and organizations like the Westboro Church will recognize an age-old principle: gifts that are not respectfully acknowledged will be scarce in the future. Unfortunately, the freedom of speech is a gift, not an inalienable right. Thanks to the Westboro Baptist Church’s repugnant actions, the Supreme Court may now limit this gift.

Apparently simple values like respect are missing from the church’s Sunday School curricula.

Beck, Limbaugh, and Malkin Says "Eff Your Kid's Story."


Let me get this straight off the board here. The Smoking Ace loves the kids especially when they have stories to tell, truthful or not. I am just a sucker for children though I don’t have any. When a kid tells a true story about the things that are going on in his life, I cling to listen to it. Take Marcelas Owens (young man on the left) from Washington. His mother got sick, lost her job, lost her health insurance, and died. Just telling the story in a long version is seriously sad.

…..Don’t tell that to the Mt. Rushmore of Republican talk: Glen Beck, Rush Limbaugh, and Michelle Malkin.

Never mind that there is not a shred of evidence that any health insurer ever “abused” Marcelas. Never mind that the family has made no claim that Marcelas himself has survived without insurance (in Washington state, low-income children have been covered either through Medicaid, SCHIP, or the SCHIP expansion program Apple Health for Kids).(see transcript)

And good ole uncle Rush said:

A little more research on the Washington Community Action Network. Technically, these people are not SEIU but they are involved with them. It's close. I want to be accurate here. They got 50,000 members. That's who the mother of the woman who died works for, still the woman died. And then the woman's death is exploited by these people, along with the 11-year-old kid. You see, this is what really kills me about Republican talk show pundits. They are heartless. They are saying “Since this little kid told his story, we are going to exposed his grandmother.” This kid believes that he can make a difference in each person life by telling his heart-warming story. This is not some sort of "Balloon Boy" incident, this is a child with a life that want to do better. There are certain things I say that is off-limit, ridiculing kids is a definite high priority. When the young kid came and said his speech at CPAC. I did not see one Democratic pundit ridicule him nor his parents. What conservatives think is that this young kids was exposed to say that. What if that child is telling the truth will shame all the humanity of the Republican party to the world. People are already saying that "All the Republicans want is what used to be. Things have change and people also change too." What these people are doing is calling bullying. If that is how you play it, do not get mad Michelle, Rush, and Glen if anybody start talking about you family members and such.

Should children be off-limits when they tell their story about things that concerns issue? If these people said something negative about you or your children and you belief of what you feel is true based on experience, what would you do?
